1. Overview of Decree 53/2020/ND-CP

Decree 53/2020/ND-CP, issued on May 5, 2020, outlines important regulations regarding environmental protection fees for wastewater. It applies to businesses, organizations, and individuals who discharge wastewater directly or indirectly into the water environment. The fees are specifically determined based on the type, level of pollution, and quality standards of the wastewater.
The calculation of industrial wastewater treatment costs is based on the volume of discharged wastewater. The fee collection is conducted by businesses, organizations, or individuals who self-declare and pay fees periodically. The state environmental management agency has the authority to inspect and supervise the declaration and payment of these fees.
Regarding the use of environmental protection fees, the decree clearly states that the collected funds will be used to finance water environmental protection activities and compensate for damages caused by environmental pollution. Decree 53/2020/ND-CP on industrial wastewater treatment costs took effect on July 1, 2020, replacing Decree No. 154/2016/ND-CP on November 16, 2016, of the Government on environmental protection fees for wastewater.

2. How are industrial wastewater treatment costs regulated in Decree 53/2020/ND-CP?

2.1 Article 6 on Environmental Protection Fees

Article 6 of the decree sets out the regulations on fees to be paid.

a) For facilities with an average annual wastewater volume of less than 20 m³/day, a fixed fee and variable fee apply as follows:
- 2020: 1,500,000 VND/year.
- From 2021 onwards:
  - Wastewater volume from 10 to under 20 m³/day: 4,000,000 VND/year.
  - Wastewater volume from 5 to under 10 m³/day: 3,000,000 VND/year.
  - Wastewater volume under 5 m³/day: 2,500,000 VND/year.

b) For facilities with an average annual wastewater volume of 20 m³/day or more, fees are calculated using the formula F = f + C, where:
- f is the fixed fee: 1,500,000 VND/year (from 2021 onwards, 4,000,000 VND/year or f/4 if the facility starts operations after the first quarter).
- C is the variable fee, calculated based on the pollution indicators of the wastewater.

c) Pollution indicators are determined based on national technical standards or in environmental dossiers approved or confirmed by state management agencies.

d) The daily wastewater volume is determined from actual measurement data or inspection results from competent state environmental management agencies.

2.2 Article 7 on Determining the Fees Payable

a) Facilities with an average wastewater volume of less than 20 m³/day pay fees according to the regulations.

b) Facilities with an average wastewater volume of 20 m³/day or more calculate quarterly fees using the formula Fq = (f/4) + Cq.

c) The variable fee is calculated for each pollution indicator as follows:
- Fees payable (VND) = (Total volume of wastewater discharged into the receiving source (m³) x Concentration of the pollution indicator in wastewater (mg/l) x 0.001) x Fee rate for the pollution indicator (VND/kg).
- For facilities conducting periodic wastewater monitoring: Fees are declared and calculated based on periodic monitoring data every 3 months or 6 months.
- For facilities conducting automatic and continuous wastewater monitoring: Fees are calculated based on the daily average value (24 hours) of the measurement results.

d) If a facility has multiple wastewater discharge points, variable fees are calculated at each discharge point.

2.3 Article 8 on Declaration, Verification, and Payment of Fees

The declaration, verification, and payment of fees are crucial provisions in the decree.

Facilities with an average wastewater volume of 20 m³/day or more must declare and pay fees quarterly. Facilities with an average wastewater volume of less than 20 m³/day must declare and pay fees once for the entire year. The fee collection organization is responsible for coordinating with relevant agencies, verifying fee declarations, and managing the collected fees. For facilities under the management of the Ministry of Public Security and the Ministry of National Defense, declaration and payment of fees are carried out according to specific regulations. This ensures that production and processing facilities contribute to environmental protection by paying fees in accordance with regulations.

2.4 Article 9 on Fee Management and Use

The environmental protection fee collection organization must remit all collected funds to the state budget to ensure operational funding. In cases where industrial wastewater treatment costs are regulated, 25% of the collected funds may be retained to be used for investigation, measurement, management, and inspection activities related to industrial wastewater discharge facilities. The remaining funds must be added to the local Environmental Protection Fund for use in environmental protection activities. Each year, the fee collection organization must publicize the amount of money collected in the previous year through mass media so that the public and businesses are informed.
