With this permit, businesses are allowed to discharge waste into the environment, manage waste, and import scrap from abroad as production materials, subject to compliance with environmental protection requirements as stipulated by law.

1.1. What does an environmental permit include?

According to the provisions of the Environmental Protection Law, the environmental permit will integrate the following procedural documents:

  • Certificate of completion of environmental protection works.
  • Permit for discharging wastewater into water sources (as regulated by water resources law).
  • Permit for discharging wastewater into irrigation works (as regulated by irrigation law).
  • Certificate confirming compliance with environmental protection requirements for importing scrap materials for production.
  • Permit for hazardous waste treatment.
  • Register of hazardous waste generators.
  • Permit for industrial exhaust gas emissions.

1.2. Mandatory regulations when applying for an environmental permit

Regarding the entities eligible for permit issuance:

  • Investment projects falling within Group I, II, III categories, which involve wastewater, exhaust gases, and dust emissions into the environment, must undergo treatment or generate hazardous waste. All such projects must be managed in accordance with regulations during operation.
  • Investment projects, production zones, service centers, industrial clusters, or activities meeting environmental criteria, such as those specified in Clause 1, are eligible for permit issuance.
  • Urgent public investment projects as stipulated by laws on public investment are exempt from this process.

2. Competent agencies approve environmental permit documents

  • Ministry of natural resources and environment: The approval authority for reviewing and approving enterprise reports must have an environmental permit for projects spanning two or more administrative units at the provincial level.
  • Ministry of Defence, Ministry of Public Security: This applies to investment projects and agencies classified as state secrets in defense and security.
  • People’s Committee: Permits are issued for projects falling within Group II, III.
  • District People’s Committee: Permits are issued for the remaining projects.
